Insta360 responds to DJI’s claims by filing two counterclaims

last week, DJI filed two lawsuits against Insta360 alleging that the company infringed a total of six patents owned by DJI. Now, Insta360 has responded to DJI’s claims by challenging the company.

Weekend, Insta360 filed two lawsuits v. DJI in Texas District Court, alleging that DJI infringed on five utility patents owned by Insta360.

The company also made it clear that its counterclaims were in response to DJI’s claims. Insta360 Luna Ultra has been activated. JK Liu, the founder of Insta360, said in a statement:

Luna Ultra is not a response to any competitor’s product, but the result of many years of independent R&D. The fact that DJI sued the same day we launched the Luna Ultra speaks volumes – it exposes their fear of competing with a highly competitive product.

Insta360’s lawsuits allege that DJI willfully infringed its patents, including “the 8,938,161 patent,” and that it has known of those violations since at least August 2017 or June 4, 2026, when Insta360 provided a written notice identifying the patent in question.

Insta360 is asking the court to pay DJI damages, including lost profits, royalties and additional damages, including pre-judgment and post-judgment interest. These counterclaims complicate the legal battle between DJI and Insta360, and the court’s decision could have a major impact on both companies’ products in the US.
