Apple has accused the Competition Commission of India (CCI) of exceeding its jurisdiction in a new lawsuit in the country’s ongoing antitrust case. Here are the details.

For the past few years, Apple has been battling the Competition Commission of India in an antitrust investigation accusing the company of abusing its dominant position in the App Store. Apple has always denied the allegations.
The main point of contention between the two sides is how to calculate any potential penalty.
Under India’s revised competition law from 2024, fines can be based on a company’s global turnover, not just domestic revenue. In Apple’s case, the company said it could amount to a $38 billion tax, which Apple described as “blatantly arbitrary, unconstitutional, grossly disproportionate, unfair.”
Apple has repeatedly challenged the penalty framework underlying this calculation and asked the Delhi High Court to declare the 2024 law itself illegal.

Now, the CCI has filed its confidential order, accusing Apple of repeatedly seeking extensions of time that prevented the timely completion of the antitrust proceedings and threatening to pursue the case.
Almost four months later, little has changed. The CCI has given an ultimatum a few days ago, he demanded that the company disclose its financial information. In response, Apple is now accusing the CCI of overstepping its jurisdiction by requesting such documents.

After the CCI issued an ultimatum to Apple this month to submit its financial statements and scheduled a final hearing on May 21, the company urged the Delhi High Court to intervene urgently to stay the matter.
“The Commission’s decision to schedule a final hearing is an escalation of efforts to usurp the Honorable Court’s authority,” Apple said in a filing asking the court to hear the matter on May 15.
